Charter Terms & Conditions

Please review the Charter Terms & Conditions below, which outline important details regarding your booking, participation, and responsibilities. By booking a charter with us, you agree to these terms.
1. Booking & Payment
• All bookings are processed securely through our online booking partner (FareHarbor).
• Payment terms and timing (deposit or full payment) are shown at checkout.
• Your reservation is confirmed once payment is successfully processed.
2. Cancellation & Refund Policy
We understand plans change. Our cancellation policy is as follows:
• Free cancellation is available up to 72 hours (3 days) before departure.
• Cancellations made within 72 hours of the charter will be charged in full.
• Within 24 hours of departure, cancellations are only permitted free of charge if:
– The Captain cancels due to unsafe weather or sea conditions
– Mechanical or operational issues occur
– Other extenuating circumstances arise at the Captain’s discretion
No-Shows: Guests who do not arrive for their charter will be charged the full amount.
3. Weather & Captain’s Authority
• Charters operate rain or shine; however, marine conditions must be safe for all guests.
• The Captain has full authority over all safety decisions, weather calls, and navigational choices.
• If the Captain cancels the trip for safety, guests may receive a full refund or may reschedule.
4. Guest Responsibilities
For everyone’s safety and enjoyment:
• Guests must follow all Captain and crew instructions.
• Children under 13 must wear life jackets as required.
• Please arrive on time; late arrivals may shorten the charter time.
• Unsafe, disruptive, or intoxicated behavior may result in early return or refusal of service without refund.
5. Alcohol, Drugs & Conduct
• Beer and wine are allowed in moderation.
• No glass bottles on board unless approved by the Captain.
• Illegal drugs and hard alcohol are strictly prohibited.
• The Captain may refuse service or end a trip without refund for safety or misconduct.
6. Liability Waiver
By booking and participating in a charter, guests acknowledge and agree that:
• Boating and fishing involve inherent risks.
• Guests participate at their own risk and accept responsibility for personal safety.
• Black’s Pearl Sportfishing, the Captain, crew, and owners are not liable for:
– Injuries, accidents, or medical conditions
– Seasickness
– Loss or damage of personal belongings
7. Fishing Regulations, Catch & Cleaning
• All fishing must comply with Florida state and federal regulations.
• The Captain will determine what types and sizes of fish are legal and safe to keep.
• Fish cleaning may be included or offered for an additional fee depending on the charter package.
8. Media & Photography Release
We love sharing great moments on the water!
• Photos or videos may be taken during the charter and used for social media or promotional purposes.
• If you prefer not to appear in photos or videos, simply inform the Captain or crew before departure.
9. Changes to Terms
We may update these Terms & Conditions as needed. The latest version will always appear on this page.
